What is a Statement of Use?

A Statement of Use (SOU) is an official declaration submitted to the USPTO confirming that your trademark is now being used publicly and commercially in connection with your business. This filing must be completed within six (06) months from the date the Notice of Allowance is issued, and it is required before an “Intent-to-Use” application can move forward toward full registration.

In most cases, an SOU must include the following items:

  • Applicable Fee
  • One (01) Specimen of the Trademark in Use
  • Signed Statement by the Applicant

We at Trademark Tigers are here to help you prepare and file your SOU accurately so your registration continues smoothly.

What if Another Business Already Uses a Similar Mark?

If your trademark search reveals that the name or logo you want is already in use (or closely resembles an existing trademark), you may need to rethink your choice. Ignoring these results can lead to costly disputes, legal action, and potential liability if your product enters the market using a conflicting mark. Even unintentional infringement can result in paying damages or covering another party’s legal fees.

Well-known trademarks are especially protected, and their owners are more likely to take action when similarities appear. Conducting a thorough trademark search early on helps reduce these risks and prevents major setbacks for your business.
